HGA Law: Your duties as an employer regarding workplace bullying
As more and more employees are returning to work, it is important for employers to be reminded of their obligations with respect to workplace bullying. Under Alberta law, employers have a duty to create and maintain a workplace that is free of discriminatory harassment. Further, it is not enough for an employer to simply receive a complaint and offer assurances that it will be taken seriously without actually investigating the claim in a timely manner.
A recent Ontario court decision reiterates this point. The employee, who had repeatedly made assertions that she was being bullied and faced a hostile working environment, was awarded $50,000 in aggravated damages to be paid by the employer for failing to investigate the allegations.
